Terms of Service

These Terms govern your access to and use of EAA Compliance Scanner (the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. What the Service is
EAA Compliance Scanner is an automated tool that scans web pages for accessibility issues against the Web Content Accessibility Guidelines (WCAG 2.1 and 2.2), produces a score and plain-English fixes, generates VPAT and accessibility-statement documents, and can monitor sites on a schedule. The Service is NOT a legal accessibility audit, a manual expert review, or a certification of conformance with WCAG, the EU Accessibility Act, EN 301 549, the ADA, or any other law. Automated testing detects only a subset of accessibility barriers; manual testing and human judgement are still required.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into a contract. You are responsible for safeguarding your account credentials and for all activity under your account, including activity initiated by a magic sign-in link sent to your email.
3. Authorized scanning
You may only submit URLs for sites that you own or that you are explicitly authorized to test. You are solely responsible for having the right to scan any address you enter. You will not use the Service to attack, overload, disrupt, or gain unauthorized access to any system, and you will respect target sites' technical limits. Scanning fetches and renders pages and may capture screenshots of the pages you submit.
4. License to the output
Subject to these Terms and payment of any applicable fees, EAA Compliance Scanner grants you a non-exclusive, non-transferable license to use the scan results, reports, VPAT documents, and accessibility statements generated for your own and your clients' lawful purposes. We retain all rights in the underlying software, rule engine, templates, and branding.
5. Fees, billing, and auto-renewal
Paid plans are billed by Polar Software Inc., our merchant of record, in the currency displayed at checkout. Subscriptions renew automatically at the displayed interval until you cancel. Cancellation takes effect at the end of the current paid period and does not refund the current period except as set out in the Refund Policy.
6. No conformance guarantee
Accessibility scores, issue counts, severity ratings, and legal-risk indicators shown in the Service are automated estimates for your reference only. A perfect or high score does NOT mean a site conforms to WCAG, the EU Accessibility Act, or any other standard, and a VPAT or accessibility statement generated by the Service is a self-assessment based on automated results, not an independent certification. Consult a qualified accessibility professional before making any conformance claim.
7. Warranty disclaimer
THE SERVICE, ALL SCAN RESULTS, AND ALL GENERATED DOCUMENTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, that every accessibility issue will be detected, or that any output is suitable for any specific use.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim. In no event will we be liable for indirect, incidental, consequential, special, or punitive damages, including any regulatory penalty or third-party claim arising from reliance on automated scan results.
9. Indemnification
You will defend, indemnify, and hold harmless EAA Compliance Scanner and its officers, employees, and agents from any claim, demand, loss, or damages, including reasonable legal fees, arising out of or related to your use of the Service, the URLs you submit, your lack of authorization to scan a target, or your breach of these Terms.
10. Suspension and termination
We may suspend or terminate your access at any time for any reason, including suspected violation of these Terms or our Acceptable Use Policy. You may stop using the Service at any time. Sections that by their nature should survive termination (fees owed, warranty disclaimers, liability limits, indemnification, governing law) will survive.
11. Governing law and dispute resolution
These Terms are governed by the laws of Ireland, without regard to its conflict-of-laws rules, and the courts of Ireland have exclusive jurisdiction, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally. 12. Changes
We may update these Terms from time to time. Material changes will be announced via email or in-product notice at least 14 days before they take effect. Continuing to use the Service after the effective date constitutes acceptance.
